Two female former inmates have sued the Davidson County Sheriff’s Office for allegedly housing them with a male.
The case revolves around Carla Brenner, who identifies as a woman but claims to have male anatomy. Brenner sued DCSO last year for wrongly sending her to the female ward.
Merinda Waller and Shellby Horton, two of Brenner’s former cellmates, filed their suit in the U.S. District Court for the Middle District of Tennessee earlier this month. They claim being housed with a male was “unconscionably cruel and unusual punishment.”
The suit claims Waller and Horton were subjected to multiple strip searches in front of Brenner. They also contend that DCSO employees lied to them about Brenner’s classification, insisting that she was a female.
“The stress, anxiety, distress, verbal and physical abuse, fear of not knowing what was going to happen to them, and adjustment to confinement with a male resulted in trauma and extreme pressure for the Plaintiffs,” the suit states.
The suit asks for $2 million in damages each for Waller and Horton.
Brenner, Waller and Horton are being represented by Nashville attorney James D. Roberts Jr.
