A former Metro prison guard, who was indicted on assault charges in July 2007, is waiting on a judge to decide if he should get his job back.
A jury has acquitted Joshua Barber, the former guard at the Charles Bass Correctional Facility, who allegedly attacked convicted child rapist Jeremy Duffer.
Duffer was sentenced to 137 years in prison in July 2007 for raping pre-teen boys he met through his employment at a game store in Old Hickory.
Barber was suspended without pay and then fired.
Now that he's been found not guilty, a judge will look into the appeal of that termination to see if Barber should get his job back.
