New law to revoke biz license for employing illegals

An employer’s business license can be revoked if he’s found knowingly employing an illegal immigrant under a new state law becoming effective Jan. 1.

The yet-to-be-implemented law, passed during the last session of the state Legislature, was one of the General Assembly’s targeted efforts at combating illegal immigration while dealing with the limitations federal law presents on the hot-button topic.

When the bill was initially introduced, the revocation of a business license was not the objective. The goal of the legislation was to fine employers found knowingly employing illegal immigrants $10,000.

A state attorney general’s opinion, however, said that federal law pre-empted the state from imposing criminal sanctions on the suspected employers. Any law passed by the state that did that would be invalid, the opinion stated.

Therefore, legislators settled for the license revocation tact, which is permissible under federal law according to the attorney general’s opinion.

“We couldn’t do anything about that,” said Sen. Bill Ketron (R-Murfreesboro), the bill’s sponsor. “So we went after the civil side.”

The law will empower the state’s Department of Labor and Workforce Development to take away an employer’s business license if the employer is found knowingly employing an illegal immigrant.

As many times is the case with illegal immigration issues, there are some hurdles to be cleared in the new law before the labor department could revoke a business license.

First, a complaint must be filed with the labor department. That complaint, however, must come from a state or local government agency or entity, according to the law.

Then, the Department of Labor’s commissioner must conduct an investigation. If probable cause is found that the suspected employer has hired illegal immigrants, a hearing is held.

Finally, if the Department of Labor finds the employer has employed an illegal immigrant, the commissioner can direct the employer’s business license to be revoked, suspended or denied.

“Our labor standards division is enforcing the new law and the complaints have to come from a local or public entity,” said Milissa Reierson, spokeswoman for the Department of Labor. “And once we get a valid complaint, we will investigate the complaint.”

For the first violation, the license will remain suspended until the employer can show “to the satisfaction” of the labor commissioner that he or she is no longer employing illegal aliens.

Second and third violations cause the employer’s license to be suspended for one year.

The soon-to-be-effective law does provide employers some cover.

If the illegal immigrant has presented proof that he or she is in the country legally — and that documentation turns out to be fake — the employer can’t be punished.

Ketron said he would be inquiring with the Department of Labor early in the legislative session how prepared they were to enforce the law.

“Hopefully employers will understand they can’t afford to lose their business license for a year,” Ketron said. “I couldn’t stand to lose mine for a week.”

The measure’s House sponsor, Rep. John Hood (D-Murfreesboro), couldn’t be reached for comment.

Even though TN already had laws but didn't enforce them this is great that something is finally being done to remove all that is illegal.Now they can put the welfare, porch sitting, drug dealing prostitutes out of public housing and put them to work. Allowing them to live in government assistance is also illegal so now they can go to work.

It sounds great until you get to this part:"If the illegal immigrant has presented proof that he or she is in the country legally — and that documentation turns out to be fake — the employer can’t be punished."First off, the employer should be responsible to check every SS#, whether or not it comes from a legitimate-looking document. The federal government even has free web sites where you can do this. Second, this provides a window for employers to create the fake documents THEMSELVES if they want to continue hiring illegals.Consider this law 100% worthless unless that part is changed.

It's common knowledge that you can go over to Nolensvlle Rd and purchase fake ID any time. I've seen their handy work. It's incredibly convincing. And these guys who are exploiting us are getting paid way more than us at the end of the day because they're not paying any taxes. Gee, why would they want to go home?

Although the sponsors in the legislature touted this law as a response to illegal workers, it actually waters down prior law. Under the existing statute, the employer didn't get extra chances, nor did the complaint have to originate with another government agency. Instead, it deemed hiring unauthorized aliens to be an unfair labor practice, the employer lost his business license permanently, and a complaint could have been filed by legitimate employee or applicant. The problem was that the Dept. of Labor never issued implementing regulations, on the frivolous grounds that the statute was unenforceable because it also included a possible criminal penalty. While the criminal penalty would have been unenforceable because it conflicted with federal law that explicitly pre-empted state criminal penalties for hiring illegal aliens, the pre-emption provision in federal law also expressly excepted state licensing laws. Thus, while the criminal provisions were pre-empted, the license forfeiture provisions were expressly allowed. The state department of labor under both Bredesen and Sundquist lied to the people and the legislature, and failed to implement valid state law in order to benefit corrupt corporate constituents, namely developers, contractors, hotel and restaurant owners.Does anyone think that this corrupt carpetbagger government will actualy file complaints against their corporate benefactors?

I think its awesome that something is being attempted to help remove the magnet. Tennessee has been harboring illegal-immigrants for too long. I just hope these laws are enforced. IF enforced, they will work toward de-magnetizing Tennessee. It will be tough though, Girlie is correct. You can go to Nolensville Road and become anyone you want to be and they ARE very convincing.

This law is much too easy here is what we need to enact and enforce:HARSH YOU SAY??There will be no special bilingual programs in the schools, no special ballots for elections; all government business will be conducted in our language. Foreigners will NOT have the right to vote no matter how long they are here. Foreigners will NEVER be able to hold political office. Foreigners will not be a burden to the taxpayers. No welfare, no food stamps, no health care, or other government assistance programs. Foreigners can invest in this country, but it must be an amount equal to 40,000 times the daily minimum wage. If foreigners do come and want to buy land that will be okay, BUT options will be restricted. You are not allowed waterfront property. That is reserved for citizens naturally born into this country. Foreigners may not protest; no demonstrations, no waving a foreign flag, no political organizing, no bad-mouthing our president or his policies, if you do you will be sent home. If you do come to this country illegally, you will be hunted down and sent straight to jail. Harsh, you say?................. The above laws happen to be the immigration laws of " MEXICO " !

Agree on all the above, especially the list of laws in Mexico. Don't hire illegals to work on jobs and if a contractor shows up with illegals, send them packing.
