Police officer sues department for civil rights violation

A Metro patrol officer has sued the city and two fellow police officers for allegedly violating his civil rights when they hauled him into custody and made him take an alcohol analyzer test.

The suit, filed Dec. 23 in federal court in Nashville, contends Officer Joe A. Pennington was subjected to an illegal search and seizure following a fight at the Red Iguana night club on Broadway a year ago.

Because he was forced to take the breath test under protest or risk losing his job, the complaint says Pennington is entitled to damages under U.S. Constitutional provisions governing due process and unreasonable search and seizure.
