Should the legal blood alcohol content threshold be lowered from .08 to .05 as has been suggested by the NTSB has recommended?

Why .05 when they can't catch half the .08's now.? A large number of those
presently arrested have to wait months for a trial and about as long to put
in their 48 hours+ as jail time. " Doesn't sound prudent" as Mr.Carvey would
say, in spite of another Government Agency recommendation.

0.05 is so low as to be within the margin of error for many, if not most breathalyzers....but for these professional zealots, logic and science are irrelevant...it's a modern day witch-hunt....and of course, it's all "FOR THE CHILDREN.

Who would dare to oppose such a highly moral and dedicated group of high-minded experts? Nobody.....ergo, this ridiculous idea will probably become law.

Somebody's brother-in-law over at the NTSB must have cornered the market on a new generation of super-sensitive portable breathalyzer ?

We know that special interests call all the shots in Washington, DC....some special interest is lobbying for this change and the motivation is not very lofty....follow the money.....smells like another sweetheart contract deal.

Certainly, the legal profession would lobby for this lowering of the standards for a DUI charge....ever since the divorce business went to hell, the legal eagles have had to resort to ambulance chasing, acting as soldiers in the Drug War and working the DUI-DWI motherlode.....again, follow the money.

Absolutely not! The DUI business is already one of the sleaziest laws on the books.

The DUI laws are already a contemporary version of the Prohibition era.

P.S. I am an observer of this law only. I am speaking with any personal experience with the law itself. The very thought of being subjected to a 49,000 dollar a year cop is enough in itself to keep me away from the wheel.

It was only a few years ago, when the idea of forcing Americans to give self-incriminating evidence was generally considered to be unconstitutional, as it violated both the 5th and the 4th amendments....but, because there was a perceived greater good, an over-arching imperative, to protect the general population from drunken drivers, as opposed to preserving constitutional freedoms, DUI-DWI laws began to flourish in number and severity.

Same thing for “controlled substances”, such as Cannabis.

But when it comes to gun ownership and use, government has shied away from using this "greater good" concept, to control the gun-related carnage.

It's all about the special interests...there is no powerful lobby of freedom-loving drivers...there is no powerful pro-Cannabis lobby….but, there are several extremely powerful guns & ammo lobbies….we have the best government and criminal justice system that money can buy.

Thurston Howell III used that same line in an episode of Gillgan's Island....I think that the same line appeared in a Grey Poupon ad in the early 80's.

Since the air in a closed vehicle is rebreathed by all aboard, could the very presence of a thoroughly drunk person or two in the same car, along with a non-drinking driver, be enough to cause the non-drinking driver of that car to blow a 0.05 BAC?

With such a trace BAC level being sufficient for arrest & conviction, could designated drivers now be at risk?

I agree with the rest of you. This doesn't prevent people from drinking and driving. If they truly cared about public safety they would take measures against the people who have multiple DUI's and are still driving and killing/hurting others and damaging property for which they will not pay to repair.

My favorite Detlefsen piece is entitled, "The Letter"....I cannot find a good online image of the piece, but here is the jigsaw puzzle box image...the image was used by MB in their "good old days" jigsaw puzzle series, it is now quite rare.


There is a rural letter carrier, with letter in hand, in the center of the view, he and his horse & buggy along with the ferryman are all on a hand-operated ferrying raft, crossing a stream...a young lady, in the foreground, waits for the letter, as a nearby young boy, perhaps a younger brother and his dog do their things ....it's a very engaging image that every rural letter carrier would appreciate.

That painting has truly fallen through the cracks...I can't find a print of that piece....I'd certainly buy one, if I come across it....I have several Detlefsen prints.

Loner, I can remember seeing a storm years ago. After it had passed I went out and look at such a amazing sight in the distance. The lightning could be seen under a a thunderhead cloud, by a full moon. I will never forget how beautiful it was.

As far as cops go I have a plan. Never ever put yourself in a position where one might be forced into dialogue with a cop.

I had seen the graph you pointed out. It certainly is interesting data. I am not sure what you wanted me to see , but along with other data it concisely pointed out that 47% paid no federal income tax. That is the only point I have made.

There is a category that troubles me. It is the working poor. This is the category that requires the most study. I have mixed feelings as to the cause and remedy for this.

I lean very strongly to a world market depressing wages in the USA for the unskilled. It should be a very high priority for every liberal .conservative, democrat or republican.

This is the category with whom I have the most empathy.

Surprised Tennessee isn't one of those red welfare states given that it has consistently received more in Federal funding than it has paid in Federal taxes for at least the past 30 years. Southern states constantly claim they are fiscally responsible, yet there isn't a damned one of them that could balance it's budget without Federal funding.
