We generally support Sen. Bill Frist, but we think legislation he pushed to put a cap on pain and suffering in malpractice cases has some flaws.

The bill, which the House of Representatives passed in March, would limit monetary awards for pain and suffering to $250,000. It would not affect recouping actual medical costs.

Frist and other proponents of the cap argue that malpractice insurance has gotten so prohibitive that some physicians are leaving their practices, thereby limiting the amount of quality health care
