Dangerous litigations

President Barack Obama most assuredly wants to appoint some person to the Supreme Court who shows empathy or sympathy to litigants who come before the Court. I believe most any good American has both of these fine traits in their system.

However, not just any good American can, or should, be on the Supreme Court if their legal decisions are based on these two traits. After all, this great country called the United States of America is based on laws and not pre-perceived sympathy or empathy for certain individuals or groups.

Lady Justice is a statute found in just about every courtroom in America. It is depicted wearing a blindfold. This is done in order to indicate that justice should be handed out objectively, without fear or favor, regardless of identity, person or weakness. In other words, blind impartiality and blind justice.

Mr. Obama, in his writings and his voting record in Congress has already shown that he will insist on an appointee who has the capacity to understand others and decide cases based on his or her sympathetic understanding of a litigant, not their understanding of the Constitution. This is dangerous.

I agree. It also leads to corruption of the system and implimatation of personal beliefs as the law of the land. An opinion from SCOTUS carries the same weight as law passed by the legislature and becomes expandable by minor players (lower court judges) as we have seen with Roe v Wade. Now they are killing kids inches and seconds before birth.

Hell barry/BO even argued that if they are borned after a botched abortition they could be left to die.

Fear ,Fear , Fear ! Holy Moses.

By: dooley on 5/19/09 at 4:22

You righties will never learn That crap won't fly any more .

By: Captain Nemo on 5/19/09 at 4:41

Good morning.

Would Ray Sharer be writing this letter if McCain had been president?

By: daKine7 on 5/19/09 at 5:00

Obama was a Harvard grad and taught Constitutional law. I'm sure he knows the US Constitution more than 100% of the people writing this paper. True, at 47 years of age, he's relatively young and inexperienced. I like that about him. He's not like some relics in Washington who have been there for 50 plus years, corrupted, jaded, on the take, and out of touch. And what's dangerous is the typical American walking the streets, our judicial system out of wack ("fair" only if you got the cash), and anyone who voted for GW Bush TWICE!

By: Loner on 5/19/09 at 6:33

Good morning, Nashville!

Ray Sharer's LTE expresses a common fear held by most Republicans; they fear that the right-leaning, Bush-dynasty court is going to become more centrist and representative of the views of the nation as a whole.

Ray talks about the "statute" of Lady Justice, he was referring to the Statue of Justice, Justitia, the famous, often-copied, sculpture. I'm surprised the editors didn't catch that error.

Mr. Sharer beats his breast and whines, "this great country called the United States of America is based on laws and not pre-perceived sympathy or empathy for certain individuals or groups". Sorry, Ray, this country was based upon male superiority, white supremacy and ethnic cleansing of the native peoples.

The 1st Amendment is perhaps the most egregiously violated element of the US Constitution. From US-taxpayer support for establishing the Jewish State in Palestine to the Faith-based Initiative, America has slid into theocratic democracy and is proceeding full speed into democratic theocracy. Next stop: Armageddon.

By: daKine7 on 5/19/09 at 6:42

Loner: Thank's for the pick-me-up. Armageddon? It's only Tues. and summer is a month away.

By: house_of_pain on 5/19/09 at 6:51

We can't have Armageddon now.
Football season kicks off in 144 days.
Can't it wait until after the Superbowl?

By: daKine7 on 5/19/09 at 6:55

Yes, please. My summer squash and tomatoes haven't emerged as yet. Why all the existential angst? It's going to be 78 degrees today. The sun is shinning. Go for a walk at Centennial Park. Feed the ducks. Lay off the pipe.

By: Loner on 5/19/09 at 6:59

You're welcome, daKine7. Did you notice that Netanyahu succeeded in getting Obama and the USA to commit to a timetable for "action" on Iran?

Sounds like another Israeli-engineered, pre-emptive war by way of countdown, just like the US invasions of Kuwait and Iraq. Bibi wanted a 90-day countdown to military action, Obama is giving Iran until the end of this year to knuckle under - or else. Israel will hold the US to that promise, if Bam balks, he'll join JFK and the others who defied Israel and its Mossad. Joe Biden is another LBJ.

Of course, our "greatest military ally" will once again let the US do the heavy lifting, while they sit out another war being fought for their benefit.

Holy Wars Suck.

By: house_of_pain on 5/19/09 at 7:07

I agree, d7, but I only go to Centennial Park when I have my wife & kid with me as proof that I'm not looking for a George Michael-esque encounter.

By: daKine7 on 5/19/09 at 7:12

Loner: You're depressed about what's going on in the world? Me too. But, for therapy you can book a Vienna trained psychiatrist at $180. for 50 minutes and talk about your mother (eek!), or go to "You Tube"..Three Stooges, and punch up the "Pie Fight". You'll be singing in the shower in no time.

By: Dragon on 5/19/09 at 7:27

The letter writer is absolutely correct. EQUAL justice is a founding principle of this country. The Constitution and laws are the authority, not what an "empathetic" judge decides should be the law.

Todd Zywicki said it well in a recent WSJ editorial. "The rule of law, not of men -- an ideal tracing back to the ancient Greeks and well-known to our Founding Fathers -- is the animating principle of the American experiment. While the rest of the world in 1787 was governed by the whims of kings and dukes, the U.S. Constitution was established to circumscribe arbitrary government power. It would do so by establishing clear rules, equally applied to the powerful and the weak."

By: Loner on 5/19/09 at 7:31

No, I'm not so much depressed as I am angry. With the help of a compliant media, the Israel-first lobby made huge gains in the past two weeks.

AG Eric Holder, Marc Rich's (pardon) lawyer, decided, last week, to drop the case against AIPAC for that spying episode, comitted a couple of years back. That was a gift to the 7,000 AIPAC delegates who gathered in Washington for their annual love-fest. Holder is a de facto Israeli agent.

Now Obama has set into motion an Israeli plan to attack Iran, using the US as its proxy bully or co-conspirator. I am sick and tired of that racist, colonial enterprise dictating US foreign policy, meddling in our electoral politics and co-opting our media.

Others believe that, as the Chosen People, the Israelis are our natural overlords and that they act with Divine sanction. Many religious Americans actually believe that those who resist Israeli infiltration and dominance are in league with Satan.

By: daKine7 on 5/19/09 at 7:36

Angry, depressed, audited by the IRS, whatever....watch the "Pie Fight". It will cure what ails you.

By: house_of_pain on 5/19/09 at 7:42

Loner, you still have the subject of torture on your livejournal, maybe that's bringing you down. Change the topic to kittens & daffodils, maybe.

By: Loner on 5/19/09 at 7:42

Dragon schlepped in a WSJ quote, that paper has devolved into a propaganda rag, ever since Rupert Murdoch got his filthy hands on it.

Far from "establishing clear rules, equally applied to the powerful and the weak.", the 1787 document codified white supremacy, and male superiority while ignoring the human rights of the native Americans. Todd Zywicki does not know what he is talking about.

By: Loner on 5/19/09 at 7:45

Yes, Pain, it is time for a new new_york_loner Journal Entry. The Bibi-Bam visit could be next; but don't expect any pollyannish, feel good, happy talk. Maybe it's time for a morning bowl....if the kids didn't finish off my weekend stash.

By: daKine7 on 5/19/09 at 7:46

OK, if the "Pie Fight" doesn't work, do what I do. Alfred Hitchcock's shower scene in "Psycho". That will do it.

By: Captain Nemo on 5/19/09 at 8:02

Maybe what Loner needs is a cartoon to cheer him up.

Here is a verbal cartoon.

Rush Limbaugh feeding hat to the GOP elephant. The hay has the words hate, fear, and paranoia written on it.

On the ground just behind the elephant is a heap of elephant dropping with Bush and Chaney printed on them.

There is a jester planting plastic flowers in the mound. The bubble caption says, "It is so perrty."

"Obama was a Harvard grad and taught Constitutional law. I'm sure he knows the US Constitution more than 100% of the people writing this paper."

Must I remind you that lawyers go to law school to learn the law and find the loopholes and other ways to skirt the law. Many lawyers enter politics in order to impose their own will on others.

Don't forget, Obama is a lawyer.

By: CAH on 5/19/09 at 8:07

Loner, regardless how much you protest it, your diatribes against Israel are bordering on Hate Speech. I'm coming close to thinking that you are, at heart, a racist. If the board manager agrees with me, you might be banned again. You might want to tone it down a bit.

Just sayin'.

By: Dragon on 5/19/09 at 8:10

Of course, an empathetic judge could have him arrested for inciting hate as is done in some places in Europe. All he needs to do now is deny the holocaust.

By: Loner on 5/19/09 at 8:12

Sorry, fellas, whenever an American-educated, foreign demagogue with a massive inferiority complex comes to Washington and sets the agenda for America, I tend to get a little perturbed.

As Bibi left for Washington, another state-sponsored housing development, for Jews only, in the Arab West Ban, got underway.

Bibi is going to run circles around Bam, this neophyte prez will be easy pickin's for a wiley old coyote like Bibi Netanyahu.

With Rahm Emanuel, the IDF vet and ballerino close at hand, Obama will not stray far from the Israeli program and script. Or else.

Noto bene: Joe Biden did address the AIPAC conventioneers - half of the US Congress attended the meetings. No other nation on earth has ever had that much clout in the USA. The Founders would be alarmed at this faith-based spectacle.

By: 2476 on 5/19/09 at 8:13

Maybe he can appoint either Nancy Peeloser and she can deny everything that she is involved in or maybe he can appoint VP Biden and he can expose every secret thing this country has.

By: Captain Nemo on 5/19/09 at 8:16

I don't agree with all of Loner's stands against Iareal, but I don't think you can call him a racist.

By: house_of_pain on 5/19/09 at 8:17

Loner's no racist, he is a sax-ist, though.

By: Captain Nemo on 5/19/09 at 8:20

A sax-ist he is. lol

By: Dragon on 5/19/09 at 8:21

The last I heard, Jewish described a religion, not a race.

By: CAH on 5/19/09 at 8:26

Dragon, get a newer hearing device. The term can be used for either.

By: Captain Nemo on 5/19/09 at 8:26

You are correct Dargon.

A racist would think Jewish is a race. So many people do think that.

By: CAH on 5/19/09 at 8:28

I'm an American. Being an American is my religion. What other religion allows you to choose a new God every 4 or 8 years?

By: Captain Nemo on 5/19/09 at 8:30

To much cool-aid in the morning, CAH?

By: Loner on 5/19/09 at 8:32

CAH, are you threatening me?!

It's a local call to the NCP Webmaster, go ahead, drop the dime. I still have my blog, if I am banned here again, the regulars will know where to find me.

The topic of today's LTE is the US Constitution. The First Amendment is relevant subject matter. Netanyahu's visit and the AIPAC Convention are current events and therefore fit for discussion here.

How dare you call me a "racist" using "hate speech"? If you want to see real live racism, go to Haaretz, Ynet or the Jerusalem Post and read what Israeli posters and their US enablers are saying on those boards. Read those hateful, racist comments and then try to honestly tell me that the Israelis are an exceptionally moral people and the innocent victims of racism..

If placing America's national interests on a higher plane than those of the Jewish State in Palestine constitutes "hate speech", in your mind, you need professional help, CAH.

If the NCP also thinks that defending the Constitution, as I have, is "hate speech", then I'll gladly take a hike.

By: Captain Nemo on 5/19/09 at 8:44

Maybe that is what is wronge with the country. To many people think that it is a religion.

By: Loner on 5/19/09 at 8:53

Dragon, didn't you get the memo? The Israelis crafted new language that calls for the Palestinians to recognize Israel as "a Jewish State, homeland of the Jewish People". That's one of the upgraded, crippling pre-conditions for negotiations. The right to exist has been expanded to include the "people" part.

Not only that, the new and iimproved 2-state lingo includes this made-in-Israel buzz-phrase, "Two states for two Peoples". Subtle, but still apartheid in the Holy Land.

Yes, Judaism is a religion and one can convert to Judaism. But now, the Israelis are demanding that the world's Jews be recognized as a "people"; that implies an ethnic or racial component to being Jewish. One can be born a Jew, or so they claim.

Christians are not born as members of the "Christian People". Muslims are not born as members of the "Muslim People". The Jews want it both ways - depending on the situational ethics of the moment.

Herzl's experiment in social engineering, race-based and faith-based colonialism in the Holy Land has failed. Militarized and polarized, Israel is on life-support...it just ain't working out as advertised.

Pull the plug, bring the Diaspora to America!

By: CAH on 5/19/09 at 8:56

Loner, a quote from "Stripes" seems appropriate. "Lighten up, Francis".

No, I wasn't threatening you. If you reread what I posted, you will see that I was just advising you that you could be getting close to the borderline.

That you responded in such a way indicates that I must have touched a nerve.

By: Loner on 5/19/09 at 8:57

Thanks for the verbal cartoon, Nemo, I laughed out loud.

Yes, Pain I am a known sax offender, a saxist with an attitude. Adolf Sax would be proud of me... I think.

By: Loner on 5/19/09 at 9:00

CAH, a quote from Cornholio, "Are you threatening me?! I have TP for my bunghole!"

By: idgaf on 5/19/09 at 9:01

Loner is a known Jew/Israel hater for years for those newcomers here.

By: Captain Nemo on 5/19/09 at 9:09

idgaf is a know hater of everything for you newcomers.

By: Loner on 5/19/09 at 9:14

Hey, if I get thrown out again, who's gonna stir up the muck that must be stirred?
Thanks, CAH, for your concern over my online well-being. I think that the NCP believes in free speech, we shall see. For the record, I do appreciate this service and I hope that the tolerance levels remain high.

I hate to keep bringing up the so-called "special relationship" between the US and Israel, but the mainstream media is decidedly pro-Israel and the Pro-Israel lobbying influence is very strong. All the leaders of the mainstream Christian faiths are all pro-Israel and act as agents of creeping theocracy.

Only a brave or foolish loner would dare to question authority on this vital issue. I'm not sure which category of loner describes me. Probably both.

By: Loner on 5/19/09 at 9:20

For any would-be newcomers: Idgaf is a useful idiot for Zionism, there is no kinder or gentler way to describe him. Bless his heart, he does provide entertainment. He waves the US flag while pimping for "The Chosen People". As I said, Id is very entertaining.

By: Captain Nemo on 5/19/09 at 9:22

Loner looks like Wille Nelson, with a New York accent. lol

By: slacker on 5/19/09 at 9:23

Cah, the expression ''hate speech'' is bulls@#$. If you don't like loners opinions, you should counter them.

By: Captain Nemo on 5/19/09 at 9:25

I did not say accent with a southern accent. It should be actseent. lol

By: Loner on 5/19/09 at 9:26

I'll accept that description, thanks, Nemo.

When I visited Music City, in 2004, two cowboys, sitting on a pickup tailgate, outside of Tootsies, asked me if I was Willie Nelson. I asked them not to blow my cover and continued walking.

By: chiefpayne568 on 5/19/09 at 9:27

I agree with idgaf on this one. If Obama wants to find someone who is knowledgable concerning the Constitution and is also empathic, all well and good. But they need to have some knowledge and understanding of the Constitution.

By: Captain Nemo on 5/19/09 at 9:27

Loner you give id more than I do.

I never in a million years considered that he had a heart.

By: Loner on 5/19/09 at 9:28

Amen, brother Slacker.
