President Barack Obama most assuredly wants to appoint some person to the Supreme Court who shows empathy or sympathy to litigants who come before the Court. I believe most any good American has both of these fine traits in their system.
However, not just any good American can, or should, be on the Supreme Court if their legal decisions are based on these two traits. After all, this great country called the United States of America is based on laws and not pre-perceived sympathy or empathy for certain individuals or groups.
Lady Justice is a statute found in just about every courtroom in America. It is depicted wearing a blindfold. This is done in order to indicate that justice should be handed out objectively, without fear or favor, regardless of identity, person or weakness. In other words, blind impartiality and blind justice.
Mr. Obama, in his writings and his voting record in Congress has already shown that he will insist on an appointee who has the capacity to understand others and decide cases based on his or her sympathetic understanding of a litigant, not their understanding of the Constitution. This is dangerous.
