Handgun opinion shot down
In regards to the state Attorney General's opinion to landlord's restriction of handguns in residences, I see good and bad for this. First of all the good would be for someone who rents out a room in their home and fear for their selves on allowing someone to live there with a weapon. This would make perfect sense in the decision made by AG Bob Cooper.
On the other side of that coin, for a company who owns many apartment units this would be a bad idea on restrictions. Again on a good and bad end, good end on banning weapons at the complex would be for the people without approved licenses to carry a weapon. Of course, just like the weapons in restaurants and bars law, criminals are going to carry and have in their possession no matter what signs and laws are posted. The bad, of course, are the people who have a handgun carry permit, so they could carry a weapon for protection. Those people should be allowed to have their weapons.
Now here is the part that will be challenged by any person who is rightfully allowed to have a weapon, and that is the violation of their Second Amendment right to bear arms. Everyone who is not a convicted felon and over the age of 21 and without mental instabilities who passes a background check is allowed by the Constitution to own a weapon for self protection in their home. Whether it be a home they bought, a home they rented or a apartment they have a lease on. Should a landlord be allowed to stop that person from possessing it?
If this becomes a larger problem, then landlords need to place a addendum to a lease stating no weapons are allowed at the residence at any time along with posted signs. Either way, you can bet there will be challenges to this opinion by the AG's office becomes law.
Gower Mills, 37209
Wouldn't that be a hate crime if a special minority needed the gun for protection? How long do you think it would be before someone is charged with failing to not allow firearms? What are they going to do if the landlord fails to enforce the lease or only enforces it unevenly? Even if you dont own the home, it is still your home.
If the tenants don't approve let them rent someplace else. In Nashville I don't blame anyone from restircting weapons.
So, I cannot have a cat I rescued from the shelter, but I can possess a "weapon"? We talking 6-shooters here, or a semi-automatic, or if I choose lovely East Nasville, a AK-47 in case the drug deal next door to me turns sour?
Gower, size counts, or didn't you get the memo?
I would think that the property owners rights surpass the rights of their tenants. If renters want to arm themselves that bad, then they can buy their own property and have an artillery.
Unfortunately a court will see the same thing. The 2nd Amendment as a part of the Bill of Rights applies to government's relationship to the people. This is a private party issue. Landlords are not required to provide for rights under the Bill of Rights. So contractually they can require that renters not do certain things, like have guns on the property he or she rents out.
The AG had no business rendering an opinion. By his own admission no criminal charges could be brought therefore the State has no interest in the question and he should not have answered it as a government official that is employeed by the state. (taxpayers)
Furthermore he puts not only himself at risk but the state should a civi case arise based on his opinion, which IMO is incorrect.
The Landlord-Tenant Act would supercede any and all opinions on the matter.
We're going to need an attorney(s) posting today to sort this thing out.
Everyone so far is an erzat expert in Constitutional law.
Good morning, Nashville!
Gower Mills followed D7's six points to success, he scored with a published LTE. Congrats!
This LTE is another of the 4-G variety - God, Guns, Gays and Guvmint. LTE's on any one of those subjects are likely to get published.in the NCP.
This particular letter is rather poorly written, IMO. The author does not clearly state what the AG's decidion was, he talks about the good and the bad but the ugly part is in the composition of the missive itself. The choppy letter meanders and wanders and there is no apparent conclusion or summation.
Apparently, subject matter trumps competence, style and skill when the Editors decide on what to publish.
An LTE explaining how and why Jesus carried a weapon and hated gays and government would probably make the cut.
Hey, the NCP has to pay its bills, I understand their reluctance to publish controversial material. 4-G LTE's are a safe bet.
In America, we have the finest free press that money can buy.
Loner: That's a very cynical approach to "intent". I thought Clouse's LTE yesterday was timely, topical, to-the-point, true, and titilating...5-T's.
As you know, by the 5th post or 1st page, the "group of elders" is off on something completely unrelated to the LTE.
I think we had gusts hitting 300 posts yesterday.
I don't like it when they print some info-mercial from an out of state lobbyist, but the gene pool here is shallow.
Look what happened when S. Ames' LTE was printed...she called all the execs., threatened lawsuits, libel, slander, and false imprisionment.
TCP doesn't need the headache.
I imaging the variety of LTE's are lacking, or hardly any at all. This would explain the same three or four people continually getting published. Just remember, this is the NCP, not the New York Times.
I hear that there may be a healthcare bill revealed today. That should send some people here into a tizzy. NOTE: it's not the final bill...relax.
I prefer this group to the ones at the Tennessean website. They may stay on topic,
but some of those folks are nuttier than a squirrel turd.
How was Florida, gd?
Pain: Florida is like sex..when it's good, it's great,..when it's bad, it's still pretty good.
Yes, I am a cynic and a skeptic, D7. I used to be a believer.
Dooley's scathing letter fell under the rubric of Guvmint.
If my Goldstone LTE had been published, the upcoming vote on HR 867 might have been more topical. I just received an E-mail about it. I called my Senators and my Rep., asking them to vote "NO" on the bi-partisan resolution, crafted by the powerful Israel Lobby. HR 867 rejects and condemns Judge Goldstone and his report, while defending and shielding the IDF war criminals from any and all accountability.
This shabby resolution was hastily put together, there will be no debate, the vote will be nearly unanimous...every lawmaker in Washington lives in mortal fear of the Israel Lobby, this is another disgusting example of how deeply de facto Israeli agents have infiltrated our central government.
It's a safe bet that every US lawmaker who votes on the matter has not read the 575-page report for themselves. The indiscriminate use of white phosphorous munitions on civilians alone is enough to warrant US condemnation of the IDF's brutal assault in Gaza. It's all in the Goldstone report.
The Nobel Prince-of-Peace is now shilling for war criminals....the Israelis call the tune, Obama tap dances.....ain't that cute?
Yes, I too am experiencing a bit of buyer's remorse with our weak-kneed. toe-tapping president. The guy had me fooled, for a while.. at my age, I should know better.
Precedence has established that the government can forbid firearms on school or government property. Business can forbid firearms in bars. I would think that individuals and companies could also forbid firearms on their properties.
Sorry, when you lease a house or an apartment, they are not considered to be your home. The forbidding of firearms by the owners is consitutional, although proper lease clauses and signage should be in place.
Loner: Just print or transcribe your LTE here. Like Mr. Harward did yesterday.
Guy even signed it w/ his e-mail address.
I'd rather read your LTE than have to ask "House" what a "nutty squirrel turd" is.
I could do that, does anyone else, besides D7, wish to see it here? Let the elders vote..should I schlepp it in here, or not?
It was good House. Unusually cold the first few days, but the last few were really nice. Kids loved it. Never lasts long enough though.
Unfurl your scroll, Loner.
welcome back, g.
Loner, I always welcome rational debate on substantive issues. Your letters would always be welcomed.
Loner,
Please...let's see your letter!
In a pinch, Loner's LTEs can be used as rolling papers...
That's three "YES" votes...by popular demand, here's the rant:
An internationally renowned jurist, Judge Richard Goldstone, from South Africa, headed a UN Fact Finding Mission concerning the 22-day Gaza Conflict. Judge Goldstone’s team was charged with investigating alleged war crimes committed during the Israeli invasion of the Gaza Strip, nearly a year ago.
The recently released, 575-page Goldstone Report accuses both Hamas and the Israeli Defense Forces of possible crimes against humanity and urges both sides to investigate themselves and bring the guilty to justice.
Israel has rejected the findings and condemned the report and its authors.
It is fair to say that President Obama’s first post-Nobel betrayal of the spirit of the award has now been officially registered. The US vote, last Friday, against endorsing the Goldstone Report, is both disappointing and tragic.
It is disappointing to witness more US acquiescence to the will of the Israeli government.
US aid to Israel amounts to over 10 million dollars every day, yet the Israelis call the tune and Uncle Sam dances.
The tragedy lies in the fact that shielding Israel from accountability, for its brutal behavior in the Gaza War, is counterproductive to US interests.
Defending the indefensible actions of the IDF only increases anti-American sentiment across the globe. The IDF used white phosphorous munitions on civilians, Arab babies melted in their mother’s arms.
Now, Israeli Prime Minister Binyamin Netanyahu has a convenient excuse to kill the already moribund peace process. Continued Israeli intransigence will now be characterized as virtuous self-defense.
Sadly, the US will get nothing but contempt from Israel in return for our attempt to shield the Israeli government and the IDF from this legitimate criticism.
Why the hell are we sending them so much moolah?
We can't even pay our own bills around here.
Loner, you should point out that the investigation was conducted without the support or cooperation of Israel, therefore the findings may be biased.
Wow...this should help their cause for Amnesty! Sheesh!

Loner,
Interesting letter. I do have a question though about it. In your letter, you said "Israel has rejected the findings and condemned the report and its authors."
I was rather curious...what kind of reception did Hamas give the findings? Did they accept them or reject them as well?
House,
"Why the hell are we sending them so much moolah? We can't even pay our own bills around here."
A better question is, why are we sending any money to anyone overseas for any reason? If we are so hard up, why not simply stop paying any foreign aid until we get our own house in order?
Here is a link to the Israel Lobby's bi-partisan resolution, HR 867:
http://thomas.loc.gov/cgi-bin/query/z?c111:H.RES.867:-]
The Resolution is dated October 23, and is sponsored by the following de facto Israeli agents: Ms. ROS-LEHTINEN (for herself, Mr. BERMAN, Mr. BURTON of Indiana, and Mr. ACKERMAN) .
Clearly ditching Goldstone serves Israel's immediate national interests but does not serve the legitimate national interests of the USA. Fawning submission to the Israelis adds more contempt to the growing antipathy felt towards the USA and our belligerent, criminal, client-state in the ME.
BTW, the kill ratio in the Gaza War was 1,400 Arabs killed, as opposed to 14 Israelis killed (some by IDF "friendly fire"). that's a hundred to one ratio....that's a slaughter. Most of the Arabs killed were women and children. Israel has maintained its brutal and inhumane blockade on Gaza, preventing any re-building efforts etc.
Yawn...I prefer Mills LTE...with Loner you know what you get...
In Phil Hartman's Frankenstein impression...."Isreal baaaaad!!"
No offense Loner, you're cool guy, but IMO, that rant gets old.
Loner,
So what did Hamas have to say about the findings?
Loner: I think I'm due a commission as your booking agent.
I think it's only fair, since I get one from "House" for getting guys for his sister.
"You like my seeester? She's a virgin..."
Dragon, the investigation was conducted without the support or cooperation of Israel, that much is true. That fact in and of itself does not mean that the report is biased against Israel.
If it had nothing to hide, Israel should have cooperated with Goldstone's team, instead of immediately stonewalling and attacking the author's character and condemning the UN, once again. Naturally, the Jewish State media are calling the criticism "anti-Semitic" and they have smeared Judge Goldstone as a "self-hating Jew".
For the record, Goldstone has long-supported the idea of Zionism in Palestine. Not that long ago, the Israelis were big fans of this distinguished jurist, now they despise him. Israeli loyalty is fickle and conditional.
Hamas and Fatah have differing views, but in general, they support the Report and have agreed to conduct an internal investigation into the charges. Israel will damn their findings, of course, calling it a whitewash...meanwhile, if sufficiently pressured, Israel will probably conduct another sham investigation of its own.
We give wealthy Israel more foreign aid than any other nation on this planet, because the Israel Lobby has the US Congress and the WH by the balls. Our sovereignty was sold out, in exchange for AIPAC support for our elected officials...its just that simple.
Pain: That was a Rodney Dangerfield line. Hope you weren't offended.
Loner: Are you serious? That LTE may get some press and traction in "Scientific American" or the JMA, but for TCP audience?
TCP likes 8-9th grade levels of intellect.
Give them what they want.
GD, you think I give a shit abiut your opinion of me or my views? You flatter yourself, boy. Go back under the porch...
Didn't bother me, d7, but my sister said she's comin' for you...
as soon as the line thins out.
I care about things that many Americans ignore.
Yes, I do care about being dragged into more Holy War at Israel's behest.
I do care whether or not American taxpayers support an apartheid state based upon Jewish supremacy and Arab dislocation.
I do not trust any nation that would engage in a prolonged air and sea attack on one of our US-flagged naval vessels, in International waters. Israel did just that and got away with the murders of 34 US sailors and the horrific wounding of 174 more aboard the USS Liberty, on June 8, 1967. The vicious, concerted attack was never a case of mistaken identity, it was Israeli perfidy, butchery and treachery.
Israeli propaganda is so effective, most Americans do not know about the Liberty incident, or they believe the Israelis, rather than our own sailors who managed to survive.
Yes, we are a gullible people, and the Israelis are taking full advantage of our weakness.
Boy THIS guys is a piece of work! Check out his take on Polanski being arrested in Switzerland!

Interesting...yet you trust the government of this nation you don't trust to look after your health care???
in opposed to the greedy, corrupt and unregulated insurance industry looking after your health?
Huh?
he's just desperate for some personal one on one attention, Loner. you're stealing the spotlight from him.
his point was disproven yesterday but he stubbornly wants to keep arguing it even though his stance is completely illogical.
A Jewish doctor walks into an Arab bar...
Good for you Loner, but I just call it like I see it, and probably a few others as well. Back to the bong, old man.
Blanket,
Can you tell me why I should substitute one greedy, corrupt and unregulated insurance industry with a greedy, corrupt, unregulated and unchecked government to look after my health?
chief, all of this was explained yesterday. apparently it is over your head.
you stubbornly stick to your argument out of your personal dislike for the president. you have no desire for knowledge, you just want to cast stones. that part is obvious.
