More nagging questions [regarding the proposed Metro nondiscrimination bill related to companies that contract with the city]:

What does "contracting with Metro" actually mean? Beyond the obvious stuff, like providing goods and services to Metro, does "contracting with Metro" include Metro contracts involving rental and leasing agreements, and buying/selling real estate?

For example, do vendors at the fairgrounds flea market have to prove compliance in order to participate?

What about the racetrack at the Fairgrounds? Does the lessee have to prove compliance with the new language of the law?

Then there's "public art.  Do the artists have to sign papers affirming their stand on the GLBT issue?

The Metro bus service, city cabs and the airport all contract with Metro, right? Are those industries included in the new paradigm too?

Will the Titans and Predators have to show compliance too?

Will businesses be considered guilty until proven innocent on this discrimination charge? Will businesses be forced to prove their innocence before entering into new contracts?

Contractors will have to make all their sub-contractors(which are
the real bulk of firms) comply with the same laws. Will this
then include an affidavit from all employees that they will
comply? Where does this lead other than to more lawsuits?
Maybe the Council should also strenghthen the discloure laws
with some real consequences for folks like the Finance Dir.
who feels the rule doesn't apply to him!

Thanks, Captain Nemo. I don't know why they used the lower case "l" in Loner, but that's OK with me. I'm flattered to be singled out like this.

I am not against the new law, I am just asking some reasonable questions here....I asked a few others on that original thread. No doubt, the intent is positive; but, human nature is what it is and the road to perdition is paved with good intentions.

If the government can demand proof of compliance, vis-a-vis the "drug-free workplace" laws, then government can probably demand proof of compliance with these new "GLBT's in the workplace" laws.

If Affirmative Action was instrumental in solving the race issue, then Affirmative Action for the GLBT community is probably coming down the road too. Smart local firms will hire a token GLBT and put the token worker on public display.

The law should be vetted by outside, independent legal counsel, before putting it into effect. This could save big litigation costs going forward.

A few more questions:

Who will enforce the law, GLBT's or straights? What are the penalties for contravening the law? Will businesses be forced to produce a token GLBT on their payrolls in order to do business with Metro? Will faith-based entities, (churches, synagogues, temples ministries etc.) be excused from observing the prohibitions against this sort of anti-gay bigotry?

These are good questions Loner, but as I understand it the businesses are only required to adopt a similar nondiscrimination policy as Metro's in order to contract with them.

11.20.130 Metropolitan government prohibited from discriminating.
It is unlawful for the metropolitan government to fail or refuse to hire or promote, or to discharge any individual, because of such individual’s race, religion, creed, gender, gender identity, sexual orientation, national origin, color, age, and/or disability.

Essentially businesses only have to add 'gender identity and sexual orientation' to the already federally mandated 'race, religion, creed, gender, national origin, color, age, and/or disability' that were set forth in Title VII of the Civil Rights Act of 1964 and subsequent legislation. I'm confident that bill is modeled after the federal policy, and if that is indeed the case it would only apply to employers of 15 or more people. This would alleviate the burden on individual and small businesses, including artists, vendors, and cabs (since I'm pretty sure they are considered individual private contractors, as opposed to being employed by their company). I would be surprised if the Titans and Predators didn't already have similar language in place either by their own choice or forced on them by their leagues, but I imagine that it would apply to them as well. There could also be language set up to 'grandfather' preexisting contracts into the legislation.

Also notice that there is no quota set up or proof asked for beyond the adoption of the language into their policy... discrimination would almost certainly still occur, but this measure would assure that the person or persons affected had some sort of legal recourse.

I think once it is enacted, I think that any infractions will have a bright light on it. That might be enough to make it work. However it would also depend on who will be the lawmakers.

And I don't mind apologizing to anyone that feels offended, but on the presidential situation I will not back down until I am proven wrong. Simply show in the Constitution where Obama is in that office legally and I will quit.

And I will repeat, you people better think about the congress allowing it to happen. At my age it won't affect me too long but you younger people, unless you are communistically inclined will suffer from it.

Although yogiman gave me an easy segue into that article, I really did bring it up to make people think about their own preconceived notions. As the researcher quoted in the article says, "it’s absolutely threatening to admit you’re wrong." I can think of a few times when strong evidence for an opposing idea has produced that initial visceral reaction in myself... I like to think that I go back to re-evaluate my positions after that initial feeling has passed, based on which position has the preponderance of evidence rather than my previously held beliefs. However, I am human just like the rest of us, and I doubt that I have always made completely objective decisions.

Unfortunately, the people who should take this article to heart the most will probably dismiss it exactly in the manner that the article describes... ironic really.
