Former Vanderbilt safety Andre Simmons is back at home in Virginia after a Nashville judge deferred a felony theft charge against him, according to attorney Ed Yarbrough.
Simmons was originally charged with burglary and armed robbery in November [1] after police said he and 19-year-old Danny Diaz Jr. broke into a dorm room and stole approximately $5,000 from another student at gunpoint.
Simmons had the burglary charge dropped and the armed robbery charge was lowered to theft over $1,000. Simmons will be on “judicial diversion,” a form of probation, for three years, according to Yarbrough. If he stays out of trouble and stays in school, he can have his record expunged.
Diaz also accepted the same deal.
Yarbrough said Simmons would attempt to enroll at another college and play football next fall.
